The Do's and Don'ts of Bankruptcy

Below are items to consider before filing for bankruptcy:

Bankruptcy Do's

  • Do hire the right attorney: Working with an experienced bankruptcy lawyer is important to the outcome of your case. I have met many clients who have lost their homes, cars, tax refunds and other assets because they had an inexperienced lawyer. I have in-depth knowledge of the bankruptcy laws, the bankruptcy judges and the trustees. I know how to best protect my clients' interests while getting them out of debt.
  • Do talk to an attorney before you buy anything, sell anything or take any other steps with your finances: Many actions will be viewed as fraud and can jeopardize your chances of getting a discharge. Contact me once you begin thinking about bankruptcy, and I will help you make smart, informed decisions.
  • Do initially meet with an attorney rather than a staff member: During your initial visit, you should talk with a lawyer, not just a paralegal or secretary. A qualified lawyer will be able to evaluate your situation fully and provide you with advice and recommendations.
  • Do review my Frequently Asked Questions: For answers to commonly asked questions and concerns, review this page and then contact me to schedule an appointment to review your options.

Bankruptcy Don'ts

  • Do not hire an inexperienced attorney: Those without experience may miss something, may be unaware of how to get clients in under Chapter 7 or may fail to protect your property.
  • Do not transfer any assets prior to filing a bankruptcy without speaking with an attorney first: This might be seen as fraud to your creditors.
  • Do not pay too much for the filing of your bankruptcy: Higher fees do not mean better quality. I offer reasonable rates for exceptional legal services.
  • Do not take out any loans prior to bankruptcy: Again, this could be seen as fraudulent.
  • Do not pay for an initial consultation: A competent bankruptcy lawyer should be able to assess your situation quickly and provide ideas for relieving your financial distress. You should use this chance to evaluate any potential lawyers and make a decision that feels best for you. I always offer free initial consultations.
  • Do not file a bankruptcy without help of an attorney: On your own, you may miss important nuances or requirements that might otherwise be beneficial.
  • Do not hesitate to call me today: I am ready and prepared to help you get the fresh start you deserve.
